Terms of Service

These terms govern your use of Nomen, a species matching plugin for Adobe Lightroom Classic, created by Brett Forsyth (“we”, “us”, “our”). By purchasing, downloading, or using Nomen, you agree to these terms.

The short version: You buy a license, you own it for that major version forever. You can use it on the number of machines your tier allows. Don’t share your key or reverse-engineer the software. Nomen provides species suggestions, not authoritative identifications. We offer a 14-day refund if it doesn’t work for you.

License Grant

When you purchase a Nomen license, we grant you a non-exclusive, non-transferable, perpetual license to use the software on the number of machines specified by your tier:

Your license is perpetual for the major version you purchased. All updates and patches within that major version are included at no additional cost. Major version upgrades (e.g., from v1 to v2) are available at a discounted upgrade price for existing customers. Your current version continues to work regardless of whether you upgrade.

Beta Licenses

Beta licenses are provided at our discretion to a limited group of early testers. Beta licenses are temporary and may be revoked at any time. Beta software may contain bugs, incomplete features, or performance issues. We make no guarantees about beta software stability or availability.

What You Can Do

  • Install and use Nomen on the number of machines allowed by your tier
  • Use Nomen for personal, professional, educational, or commercial photography work
  • Use species match results in your publications, projects, or client work
  • Make backup copies of the plugin for archival purposes

What You Cannot Do

  • Share, redistribute, or resell your license key
  • Reverse-engineer, decompile, or disassemble the plugin or its compiled binaries
  • Remove or modify license protection mechanisms
  • Use the plugin on more machines than your tier allows
  • Sublicense, lease, or lend the software to third parties
  • Use Nomen to build a competing product or service

Activation and Validation

Nomen requires online activation when you first install and activate your license key. After activation, the plugin validates your license every 30 days. There is a 30-day grace period for offline use, meaning the plugin will continue to work for up to 60 days without an internet connection.

During validation, only your license key and a hashed machine identifier are transmitted. No photo data, match results, or usage statistics are sent.

Species Matching Disclaimer

Nomen provides AI-generated species suggestions, not authoritative identifications. Match results should be treated as suggestions that may require expert verification. We do not guarantee the accuracy of any species match. You should not rely on Nomen results for safety-critical decisions (e.g., determining whether a plant or mushroom is safe to consume).

Payment and Pricing

All prices are listed in USD and are one-time payments. Prices may change at any time, but changes do not affect existing licenses. Payment is processed by Stripe. You will receive a receipt and your license key by email after purchase.

Refund Policy

We offer a 14-day money-back guarantee from the date of purchase. If Nomen doesn’t meet your needs, contact support@nomenapp.com for a full refund, no questions asked. After the 14-day window, refunds are issued at our discretion for documented technical issues that we are unable to resolve.

Intellectual Property

Nomen, including its code, design, documentation, and branding, is the intellectual property of Brett Forsyth. Your license grants you the right to use the software. It does not transfer ownership of any intellectual property.

Nomen incorporates open-source AI models under their respective licenses (MIT and Apache 2.0). Full license texts are included in the THIRD_PARTY_LICENSES.txt file distributed with the plugin.

Availability and Support

We provide email support at support@nomenapp.com for all license tiers. We aim to respond to support requests within 2 business days. We do not guarantee uninterrupted availability of the licensing server, species package downloads, or the nomenapp.com website, though we make reasonable efforts to maintain uptime.

Limitation of Liability

To the maximum extent permitted by law, Nomen is provided “as is” without warranty of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software. Our total liability is limited to the amount you paid for your license.

Account Termination

We may terminate or suspend your license if you violate these terms, including but not limited to sharing your license key, exceeding your activation limit, or reverse-engineering the software. If we terminate your license for a terms violation, you are not entitled to a refund.

Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Material changes will be communicated by email to registered customers. Continued use of Nomen after changes constitutes acceptance of the updated terms.

Governing Law

These terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms or your use of Nomen will be resolved in the courts of Australia.
